Order 6 Rule 17 CPC Application Format: Plaint Amendment Format
Forgot to add a key document in your plaint?
Or maybe the relief clause has a typo that needs fixing. You don’t need to file a brand-new suit for this. Order 6 Rule 17 of the Code of Civil Procedure lets you correct the existing plaint through an amendment.
I’ve drafted this format after seeing countless applications get rejected for silly drafting errors. This template sticks to the points judges actually care about—like where the case is currently stuck, why the delay happened, the exact words you want to add, and whether you are trying to hide an old admission. You just fill in the blanks and attach your papers.
Why use this draft?
Sometimes plaintiffs just write a vague one-page application saying “please allow amendment.” Courts hate that. If the judge can’t figure out exactly what paragraph is changing, they will simply dismiss the application.
This draft forces you to be specific. It lays out the background, gives the exact proposed text, and sets up a clean prayer. A clear application means fewer objections from the other side.
A quick scenario
Imagine you filed a suit, and six months later, a relative finds a crucial old receipt that proves your possession. You couldn’t have found it earlier. Or maybe your earlier lawyer just forgot to add a particular relief. Instead of starting from scratch, you file this application.
If your trial hasn’t started yet, the court is usually lenient. But if the trial has already begun, you must explain why you couldn’t bring this up earlier despite doing your due diligence.
What’s inside the draft?
- A brief background of the suit and its current stage.
- Clear statement on whether trial has started or not.
- Date when you found the new fact/document and why it was missed.
- Exact text of what is being deleted, added, or substituted.
- Solid grounds: proving you aren’t changing the suit’s nature, aren’t adding a time-barred claim, and aren’t erasing an admission.
- A proper prayer asking for time to file the amended plaint, plus a chance for the defendant to file an extra written statement.
How to fill it out
Download the PDF and drop in your court name, suit number, and party details. Be brutally honest about why the amendment is needed. Attach a simple affidavit and the supporting documents.
Don’t wait for the trial to end—file it the moment you realize the mistake. Also, keep the language simple. Don’t use heavy legal jargon just to sound smart. The judge just needs to know what you are changing and why.
